1. Acceptance of Terms
By downloading, installing, or using TinniRelief (“the App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and the developer of TinniRelief (“we,” “us,” or “our”).
2. Description of Service
TinniRelief is a sound therapy application designed to help users manage tinnitus symptoms through:
- Therapeutic sound playback (programmatic and remote audio)
- 12-band equalizer customization
- Notch therapy frequency matching
- Sleep timer with soft-off feature
- Daily symptom logging and progress tracking
- AI-powered therapy suggestions (iOS 26+)
3. Medical Disclaimer
TinniRelief is NOT a medical device and does NOT provide medical advice.
- The App is intended for general wellness and relaxation purposes only
- The App does not diagnose, treat, cure, or prevent any medical condition
- Tinnitus can be a symptom of a serious underlying medical condition — always consult a licensed audiologist or physician before using sound therapy
- Do not use the App as a substitute for professional medical advice, diagnosis, or treatment
- If your tinnitus worsens, you experience hearing loss, dizziness, or pain, stop using the App and consult a healthcare professional immediately
- Listening at high volumes may damage your hearing — always use the App at a safe, comfortable volume
We are not liable for any health outcomes resulting from the use of this App.
4. Eligibility
You must be at least 13 years of age to use the App. If you are under 18, you must have parental or guardian consent. By using the App, you represent and warrant that you meet these requirements.
5. Subscription and Payments
5.1 Free Tier
The App offers a free tier with limited features. No payment is required to access free-tier features.
5.2 Premium Subscription
Premium features are available through paid subscription plans:
- Monthly Plan: $4.99 per month
- Annual Plan: $34.99 per year (includes 7-day free trial for new subscribers)
5.3 Free Trial
- The 7-day free trial is available to new subscribers on the Annual Plan only
- You will not be charged during the trial period
- If you do not cancel before the trial ends, your subscription will automatically renew at the full annual price
- You may cancel at any time before the trial ends to avoid charges
5.4 Billing and Renewal
- All payments are processed through Apple’s App Store (In-App Purchase)
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
- Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and cancel your subscription in your device’s App Store account settings
5.5 Refunds
All refund requests are handled by Apple. We do not process refunds directly. To request a refund, visit reportaproblem.apple.com.
5.6 Price Changes
We reserve the right to change subscription prices at any time. You will be notified of any price changes before they take effect.
6. User Content
6.1 Custom URL Audio
The App allows you to enter third-party audio URLs for playback. By using this feature:
- You represent that you have the legal right to access and play the audio at the provided URL
- You are solely responsible for ensuring the audio you play does not infringe any copyright or intellectual property rights
- We do not host, store, or control third-party audio content
- We are not liable for any legal claims arising from your use of third-party audio URLs
6.2 Saved Data
Symptom logs, EQ settings, and frequency data you create in the App are stored locally on your device using SwiftData. We do not access or store this data on our servers.
7. Intellectual Property
All content, design, code, and features of TinniRelief — including but not limited to the App’s name, logo, sounds, interface design, and underlying algorithms — are owned by us and protected by applicable intellectual property laws.
You may not:
- Copy, modify, or distribute any part of the App
- Reverse engineer or decompile the App
- Use the App’s name or logo without written permission
- Create derivative works based on the App
8. Prohibited Uses
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to any part of the App
- Use automated means to access the App
- Interfere with the App’s functionality or servers
- Transmit any harmful, offensive, or malicious content through the App
- Use the App to harm minors in any way
9. Third-Party Services
The App integrates with the following third-party services:
- Apple App Store / StoreKit — for in-app purchases
- Firebase Remote Config — for dynamic content delivery (sound library)
- Apple Foundation Models (iOS 26+) — for on-device AI features
Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third-party services.
10. Disclaimers and Limitation of Liability
10.1 As-Is Basis
The App is provided on an “as is” and “as available” basis without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
10.2 No Guarantee of Results
We do not guarantee that the App will reduce or eliminate your tinnitus symptoms. Sound therapy effectiveness varies between individuals.
10.3 Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of data, profits, or business opportunities
- Any health outcomes resulting from use or misuse of the App
- Service interruptions or errors in the App
Our total liability to you for any claim arising from your use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit or play through the App
12. Termination
We reserve the right to terminate or suspend your access to the App at any time, with or without notice, for any reason including violation of these Terms.
Upon termination:
- Your license to use the App ends immediately
- Any locally stored data remains on your device
- Refunds are subject to Apple’s refund policy
13. Changes to Terms
We may update these Terms at any time. We will notify you of significant changes through the App or by updating the “Last updated” date at the top of this document. Your continued use of the App after changes constitute acceptance of the new Terms.
14. Governing Law
These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in a court of competent jurisdiction.
